These Terms of Service ("Terms") govern your use of the TradeStack platform and services provided by TradeStack LLC ("TradeStack," "we," "us," or "our"). By using our services, you agree to these Terms.

Service Description

Program name: TradeStack Automated Business Messaging

TradeStack provides automated SMS-based business tools for contractors and service businesses, including estimate follow-ups, appointment reminders, review requests, crew dispatch notifications, and other business communications. Contractors interact with the platform by sending text messages to their dedicated TradeStack phone number. Their customers receive automated messages on behalf of the contractor.

SMS/Text Messaging Terms

By using TradeStack, you acknowledge and agree to the following messaging terms:

• Message frequency varies based on the tools enabled and the volume of leads and jobs entered by the contractor.
• Message and data rates may apply. Standard messaging rates from your wireless carrier apply to messages sent to and from TradeStack numbers.
• Contractors are responsible for ensuring they have an existing business relationship with customers whose information they submit to TradeStack.
• Customers may receive automated follow-up messages, appointment reminders, review requests, and other business notifications from their contractor via TradeStack.

Opting Out

Reply STOP to any TradeStack message to opt out and stop receiving messages.

You will receive a confirmation message and no further messages will be sent. You may re-subscribe at any time by replying START or GO.

Contractor Responsibilities

As a contractor using TradeStack, you agree to:

• Only submit customer contact information for individuals with whom you have a legitimate, pre-existing business relationship (e.g., you provided them an estimate or completed work for them).
• Have a valid consent basis for follow-up communications with each customer you submit to TradeStack. An existing business relationship (such as providing an estimate) constitutes consent basis under TCPA guidelines.
• Not use TradeStack to send unsolicited messages, spam, or messages to purchased contact lists.
• Comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and state regulations governing automated messaging.
• Ensure customer information submitted to TradeStack is accurate and current.
• Review AI-generated messages sent on your behalf and promptly notify TradeStack of any content issues.
• Promptly notify TradeStack if a customer requests to stop receiving messages through any channel.

Subscription and Billing

TradeStack services are provided on a monthly subscription basis. Pricing varies by tool and plan. All subscriptions include a 30-day free trial. After the trial period, your selected payment method will be charged monthly. You may cancel at any time by contacting us at hello@tradestack.us.

Acceptable Use

You agree not to use TradeStack to:

• Send messages that are illegal, harassing, threatening, or fraudulent
• Send messages promoting illegal goods or services
• Impersonate another person or business
• Transmit viruses, malware, or harmful content
• Interfere with the operation of the platform
• Violate any applicable laws or regulations

AI-Generated Content

TradeStack uses artificial intelligence (Anthropic Claude) to generate follow-up messages, reply classifications, and other text content on behalf of contractors. By using our services, you acknowledge that:

• AI-generated messages may contain errors, inaccuracies, or inappropriate content.
• You are responsible for reviewing all content sent on your behalf through the platform. While TradeStack generates draft messages, the contractor bears responsibility for communications sent to their customers.
• TradeStack is not a substitute for professional business, legal, or financial advice.
• AI-generated content should not be relied upon as factual without independent verification.

Usage Limits

Message volume is subject to your subscription plan limits. TradeStack applies standard rate limiting to ensure platform stability and carrier compliance. Exceeding plan limits may result in queued or delayed messages until the next billing period. We reserve the right to throttle or suspend messaging for accounts that exceed reasonable usage thresholds or exhibit patterns inconsistent with normal business use.

Intellectual Property

The TradeStack platform, brand, and all associated software, designs, and content are the property of TradeStack LLC. You are granted a limited, non-exclusive license to use the platform for its intended purpose during your active subscription.

Limitation of Liability

TradeStack provides automated messaging services on an "as is" basis. We do not guarantee that messages will be delivered (delivery depends on carriers and recipient device status). Carriers are not liable for any delayed or undelivered messages.

To the maximum extent permitted by law, TradeStack LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including lost revenue, lost customers, or missed business opportunities.

Termination

We may suspend or terminate your access to TradeStack if you violate these Terms, fail to pay subscription fees, or use the platform in a way that could harm other users or our service. You may cancel your subscription at any time.

Changes to These Terms

We may update these Terms from time to time. We will notify contractors of material changes via text message or email. Continued use of the platform after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law provisions.

Privacy

Your use of TradeStack is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
